Acceptance of Terms

By downloading, installing, or using SIMT ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must discontinue use of the App immediately. These Terms constitute a legally binding agreement between you and SIMT.

Eligibility

You must be at least 13 years of age (or the applicable minimum age in your jurisdiction) to use the App. By using SIMT, you represent and warrant that you meet this eligibility requirement. If you are under the required age, you may not use the App.

Free Service

SIMT is provided free of charge. There are no hidden fees, subscription costs, or premium features that require payment. All core features of the App are available to all users at no cost.

Voluntary Support

Users may voluntarily support the developer and the continued development of SIMT in two optional ways: (a) by making a one-time donation through an in-app purchase processed by Google Play (which may include a digital token of appreciation), or (b) by voluntarily watching a rewarded advertisement served by Google AdMob. These options are offered solely for your convenience; you are under no obligation to use them, and they do not affect your access to any feature. Donations, in-app purchases, and ad-related transactions are subject to the terms and payment policies of the respective platform. Refunds for in-app purchases are governed by the Google Play Store's refund policy.

Acceptable Use

You agree to use SIMT only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the App in any manner that violates any applicable local, national, or international law or regulation
  • Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the App
  • Use the App to harm, threaten, harass, or infringe upon the rights of others
  • Interfere with, disrupt, or attempt to gain unauthorized access to the App's functionality, servers, or networks
  • Use the App for any unauthorized commercial purpose without our prior written consent
  • Circumvent, disable, or otherwise interfere with any security-related features of the App
  • Transmit any malicious code, viruses, or other harmful material through the App

Data and Privacy

Your use of SIMT is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you acknowledge and agree that:

  • All data is stored locally on your device by default
  • Optional features such as Cloud Backup to Google Drive and Link+ require your explicit consent before activation
  • We do not sell, rent, or share your personal data with third parties for their commercial purposes
  • Anonymous crash reports and diagnostic data may be collected solely to improve app stability
  • You are responsible for maintaining your own data backups if desired
  • You may delete locally stored app data at any time through the Data Management controls in the App

Location Services

SIMT requires access to your device's location services to provide its core compass and navigation features. By using the App, you consent to the use of your location data for these purposes. Your location data is processed on your device and is never transmitted to our servers for core features. If you choose to use the optional Link+ feature, your location may be shared securely with users you explicitly invite — either over an encrypted local Wi-Fi network or online with end-to-end encryption. You may also share target coordinates manually via the Share or QR Code features. SIMT does not access your location in the background. You may revoke location permissions at any time through your device settings.

Third-Party Services

The App integrates third-party services including Firebase Authentication, Firebase Crashlytics, Google Play Services, Google AdMob, and MapLibre GL / Google Maps. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of these third-party services. We encourage you to review their terms before using features that rely on them.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

  • The App will be available at all times or without interruption
  • The App will be free of errors, bugs, or security vulnerabilities
  • Compass readings, distance calculations, or navigation data will be accurate under all conditions
  • The App will meet your specific requirements or expectations
  • Any data transmitted through the Link+ feature will be delivered without delay

You use the App at your own risk. Navigation and compass data should not be solely relied upon for safety-critical purposes.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIMT AND ITS DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO: (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY INACCURACY IN COMPASS READINGS, NAVIGATION DATA, OR LOCATION INFORMATION; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR (D) ANY OTHER MATTER RELATED TO THE APP. THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE.

Indemnification

You agree to indemnify, defend, and hold harmless SIMT and its developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App or your violation of these Terms.

Intellectual Property

The App, including all of its original content, features, functionality, design, and source code, is the exclusive property of SIMT and its developer and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works based on the App, in whole or in part, without our prior written consent.

Termination

We reserve the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall so survive, including but not limited to limitations of liability, indemnification, and intellectual property provisions.

Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on this page with an updated "Last updated" date. It is your responsibility to review the Terms periodically. Your continued use of the App following the posting of any changes constitutes your binding acceptance of the revised Terms.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall continue in full force and effect.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict-of-law principles. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts.
